美國2004財政年度的H-1B名額已于2月份用完，造成了近8個月的H-1B真空期，對大批已經畢業的在美留學生產生了非常不利的影響。 美國移民局(USCIS)于2月17日宣布2004年的H-1B名額已經全部用完。2005年財政年度的H-1B將于2004年10月1日起繼續發放。這使得美國又出現了在98和99年網路全盛時期的半年以上的H-1B真空期。這一消息對眾多正在美國求學或已經畢業的留學生，以及數十萬正在持H-1B工作簽証工作的專業人士，都產生了極其不利的影響。 許多2003年春季和夏季的畢業生現在都處在OPT實習期，而且大部分的OPT都將會在2004年10月之前到期。由于H-1B名額已滿，使得這些畢業生在找工作時困難重重。越來越多的公司在招聘這些畢業生時都意識到，如果現在錄用他們，就算是立即給他們申請H-1B簽証，也將意味著他們在10月前有几個月的時間不能工作。這對于大多數公司project的進度來說都是不能接受的。所以現在許多公司根本不考慮錄用10月之前OPT到期的畢業生。 事實上在現在美國整體經濟和就業情況沒有根本改善的情況下，大部分的畢業生(包括OPT在10月前和10月后到期的)連讓公司考慮錄用他們的機會都沒有。由于就業市場上充斥了大量的專業人士，大多數公司在選擇員工時還是首選有專業經驗的美國公民或綠卡持有者，因為這樣會省去公司很多的麻煩和額外的開銷。 同時這一消息也造成了美國各界對下一年度H-1B有限名額的超級恐慌。美國移民局將從今年4月開始受理2005年財政年度的H-1B申請。既然移民局在從2003年10月到2004年2月短短的四個多月里，就發放了65,000個名額，可以顯而易見地預計，在從今年4月到9月 的六個月里，美國移民局將會收到超過65,000份申請。這也就意味著自2004年10月1日后開始繼續發放的H-1B，將會很快在1-2個月內用完。屆時在美國將會出現前所未有的H-1B名額的空前緊張狀態。 這一現實對于數十萬正在持H-1B簽証工作的專業人士來說也不是什么好消息。雖然H-1B的轉換和延期不受名額的限制，但是因為美國整體經濟前景仍不明朗，各公司裁員還是持續不斷。如果被裁員后不能立即遞交轉H-1B的申請，H-1B持有人也會丟掉現有的名額。就算是過了几個月又找到了新的工作，也不能再使用以前的名額，必須從新申請新的H-1B名額。 解決這一問題的根本辦法是寄希望于美國現任總統布希效法當年克林頓總統在任時期的舉措，向議會提交大幅增加H-1B名額的提案。但是據專家估計，時值美國總統大選之年，布希總統在美國大眾和勞工權益組織的強大壓力下，不太可能在2005年以前提出類似的議案。因此當前的H-1B名額危機不太可能在一、兩年內得到很快的解決。
